Crumbling Foundations Bill Dies in the Legislature’s Judiciary Committee

On Tuesday, April 2, 2018, the legislature’s Judiciary Committee voted in opposition of Senate Bill Number 518: An Act Concerning Additional Assistance For Homeowners With Crumbling Concrete Foundations on a split vote of 16 in support and 24 in opposition.

Rep. Delnicki a co-sponsor of the bill said, “I am extremely disappointed that an opportunity to build upon last year’s legislation and provide statewide insurance coverage going forward to address the issues of crumbling foundations was missed.”

The issue of crumbling foundations will only grow as more time elapses and insurance coverage for those impacted by crumbling concrete foundations continues to be an ongoing problem. Thousands of families across northeastern Connecticut have been devastated by crumbling foundations in a number of ways.

This bill would have required homeowners’ insurance policies to provide coverage for the peril of collapse, including impairment of the structural integrity of the home, and mitigation undertaken to prevent all or part of the home from falling down or caving in. It would have also adjusted the deadline for filing claims under these circumstances to ensure that claims can be filed up to six years after the inception of the loss and provided for additional funding for the Captive Insurance program.

“I will continue to advocate on behalf of all South Windsor residents and those across Connecticut who have been impacted by crumbling foundations,” Rep. Delnicki added. “This is a priority of mine and I will not rest until we find solutions to all aspects of this problem, ultimately passing legislation to fix the tremendous financial burden that so many homeowners are facing now and could face in the future.”
